Former US President Donald Trump is taking legal action against an appeals court ruling that he does not have immunity for his actions in office. Trump's lawyers filed a request with the Supreme Court on Monday to halt the ruling.

The ball is now in the court of the justices of the country's highest court. It depends on their actions whether an election fraud trial against the Republican could begin in Washington. You don't have to accept Trump's proposal. Trump's move was not surprising, as he announced in advance that he would appeal the Court of Appeals decision and appeal to the Supreme Court.

Trump was charged in Washington, D.C., in connection with attempting to rig the election. His supporters stormed the Parliament Building in Washington on January 6, 2021. Congress met there to officially confirm the victory of Democrat Joe Biden in the presidential elections. Trump previously incited his supporters during a speech by claiming that the electoral victory was stolen from him. The riots resulted in the deaths of five people.

Shortly after the election, Republicans at various levels subsequently attempted to overturn the election results. To this day, he does not acknowledge his defeat against Biden and spreads lies about election fraud. Trump now wants to run for his party again in the presidential elections scheduled for November, and regularly describes the investigations against him as a “political witch hunt.” He says the goal is simply to prevent him from returning to the White House.

Trump and his lawyers want to ensure that charges of attempted election fraud are dropped in Washington. They cite Trump's immunity from his office as president at the time. They argue that Trump cannot be legally prosecuted for actions that were part of his duties as president. But the Attorney General confirmed that Trump's attempts to overturn the election results are not part of his duties as president. The US District Court of Appeals ruled in favor of the plaintiffs last week and ruled that the 77-year-old could be tried for his actions in office.

The US Supreme Court can now suspend the appeals court's ruling in order to hear the appeal. Next, both Trump's lawyers and the prosecution justify their positions in motions. If the Supreme Court does not ultimately accept Trump's appeal, the way will be clear for the Republican's trial to begin in Washington. However, if the Supreme Court accepts the appeal, a decision can be expected from the Supreme Court on the issue of immunity. If the Supreme Court reaches a different conclusion than the Court of Appeals, the election fraud case in Washington will likely be over.

The trial was supposed to begin in Washington in early March. The responsible judge had postponed the start of proceedings indefinitely until the issue of immunity was finally clarified.

The issue of criminal prosecution of a former president is of far-reaching importance. It has great importance for future presidents. If they truly enjoyed immunity, they could commit crimes while in office without having to fear the consequences. It is also important to the campaign whether Trump is right or not. Everything so far points to a new version of the race between him and the current Democratic President Biden.

The Supreme Court has moved far right under Trump. The Republican has dramatically changed the majority on the court during his tenure. But in the past, the court did not always rule in favor of the former president.
